Omega Araştırma Ltd. Şti. ("Omega Araştırma") attaches great importance to the confidentiality and security of your personal data. Omega Araştırma aims to fully meet the requirements of Law No. 6698 on the Protection of Personal Data ("KVKK") and to maintain a data protection and processing policy in line with international standards.
This Policy sets out the principles adopted by Omega Araştırma in the protection and processing of personal data: the purposes of processing, the method of collection, legal grounds, to whom data may be transferred and the rights of data subjects.
1. Method of collection
Personal data is collected automatically or non-automatically through our website, our office, e-mail channels and similar means, in writing, orally or electronically, depending on the nature of our services. Data may be processed and updated as long as you benefit from our products and services, and also when you visit our website or digital channels or attend events, seminars and training we organise.
2. Purposes of processing
Your personal data may be processed for the following purposes:
- Fulfilment of our legal obligations under Law No. 3359 on Basic Health Services, Law No. 6698 (KVKK), the Regulation on Processing Personal Health Data and Protection of Privacy and other relevant legislation;
- Identity determination and verification to prevent personal data being seized by others;
- Protection of public health, preventive medicine, and the planning and management of health services and their financing;
- Responding to your service applications and providing information about our services;
- Risk management and quality improvement activities;
- Responding to requests and audits of regulatory and supervisory authorities; sharing information with the Ministry of Health and other public institutions as required by legislation;
- Financial reconciliation with contracted institutions and organisations within the scope of health services financing;
- Issuing invoices for the services we provide;
- Taking all necessary technical and administrative measures for data security;
- Analysing service use to develop and improve the services we offer, answering your questions and complaints;
- Preserving information related to health data required to be retained under relevant legislation;
- Compliance with internal policies and principles; measuring and improving satisfaction following service delivery;
- Informing you about our services and communicating with you for informational purposes.
3. Legal grounds
The legal basis for a processing activity may be one or more of the following: explicit consent; clear provision in law; impossibility of obtaining consent for the protection of life or bodily integrity; direct relevance to the establishment or performance of a contract; performance of a legal obligation; making the data public by the data subject; necessity for the establishment or protection of a right; or legitimate interests of Omega Araştırma provided no harm is caused to fundamental rights and freedoms. Where the processed data constitutes special-category personal data, it may be processed only under the conditions set out in KVKK, with the sufficient precautions determined by the KVKK Board; health and sexual-life data may be processed only for the protection of public health, preventive medicine, medical diagnosis, treatment and care services and the planning and management of health services financing, by persons under a duty of confidentiality or authorised institutions.
4. Security of personal data
In line with Article 12 of KVKK, Omega Araştırma takes the necessary measures to prevent unlawful processing of personal data, unlawful access to such data and to ensure their safekeeping, and prevents third parties from unlawfully processing personal data.
5. Transfer of personal data
Your personal data may be transferred, within the framework of the processing conditions and purposes set out in Articles 8 and 9 of KVKK, to group companies, shareholders, legally authorised public institutions and organisations, suppliers and business partners, service providers and/or abroad, for the fulfilment of the purposes stated in this Policy.
6. Rights of data subjects (KVKK Article 11)
- To learn whether personal data is being processed;
- To request information if personal data has been processed;
- To learn the purpose of processing and whether data is used appropriately;
- To know the third parties to whom data is transferred domestically or abroad;
- To request correction of incompletely or inaccurately processed data;
- To request deletion or destruction of data under the conditions of KVKK;
- To request notification of corrections, deletions and destruction to third parties to whom data has been transferred;
- To object to detrimental outcomes arising from the analysis of processed data exclusively through automated systems;
- To claim compensation for damages incurred due to unlawful processing.
